Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of AION and form a legally binding agreement between you and AION. By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use AION.

If you are using AION on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

AION is an AI-powered customer engagement platform that allows businesses to connect their Instagram Business or Creator accounts via Facebook Login, receive and reply to Instagram messages and comments from a unified inbox, use optional AI automation to generate and send responses, publish images and videos to Instagram, and view analytics and performance insights.

AION operates independently and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

3. Eligibility

To use AION, you must be at least 18 years of age, have a valid Facebook account linked to an Instagram Business or Creator account, agree to Meta's Platform Terms, and not be prohibited from using the service under applicable law.

4. Account Registration and Security

When you create an account, you agree to provide accurate and complete information, keep your login credentials confidential, notify us immediately of any unauthorized access at privacy@aion.app, and take responsibility for all activity that occurs under your account. AION is not liable for losses resulting from unauthorized access where you failed to keep credentials secure.

5. Connecting Your Instagram Account

AION uses Meta's official Facebook Login (OAuth 2.0) to connect your Instagram account. By connecting, you grant AION permission to read your Instagram messages and comments, send replies on your behalf via Meta's Send API, and publish content to your Instagram account if you use the publishing feature. You also confirm that you are the authorized owner or administrator of the Instagram account being connected.

You can revoke these permissions at any time from your AION settings or from Facebook's App Settings. Revoking access disables AION's ability to interact with your Instagram account.

6. Acceptable Use

You agree to use AION only for lawful purposes, consistent with these Terms, Meta's Platform Terms, and applicable law.

You must not:

Use AION to send spam, unsolicited messages, or harass individuals
Use AION to violate any person's privacy or data rights
Distribute illegal, harmful, defamatory, or infringing content through AION
Attempt to reverse-engineer, hack, or interfere with AION's systems
Use AION in any way that violates Meta's Platform Terms or Instagram's Community Guidelines
Misrepresent your identity or your business
Use AION to engage in deceptive practices toward your customers

AI Automation Responsibility

If you enable AI automation, you are responsible for reviewing the appropriateness of automated responses. AION provides automation as a tool - you remain responsible for all communications sent from your account, including those sent automatically.

7. Content and Intellectual Property

Your Content. You retain full ownership of all content you post or publish through AION, including messages, replies, images, and videos. By using AION, you grant us a limited, non-exclusive license to process and transmit your content solely as necessary to provide the service.

AION's Intellectual Property. All software, design, branding, and technology underlying AION is owned by AION and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Feedback. If you provide feedback or suggestions, you grant us the right to use that feedback without restriction or compensation.

8. Fees and Payment

AION may offer free and paid subscription plans. If you subscribe to a paid plan, fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with at least 30 days' notice. Failure to pay may result in suspension or termination of your account.

9. Disclaimers and Limitation of Liability

Service Availability. AION is provided as-is and as-available. We do not guarantee uninterrupted or error-free service. We may suspend or modify the service for maintenance or operational reasons with reasonable notice where possible.

Dependency on Meta APIs. AION's functionality depends on Meta's Graph API and related services. We are not responsible for any disruption, change, or termination of Meta's APIs that affects AION's availability or features.

Limitation of Liability. To the fullest extent permitted by applicable law, AION shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total liability for any claim shall not exceed the amount you paid to AION in the 12 months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless AION and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of AION, content you post or transmit through AION, your violation of these Terms, or your violation of any applicable law or third-party rights.

11. Termination

By You. You may terminate your account at any time by contacting us at privacy@aion.app. Your data will be deleted within 7 days.

By AION. We may suspend or terminate your account if we reasonably believe you have violated these Terms, Meta's Platform Terms, or applicable law. We will provide notice where legally required or practically feasible.

Effect of Termination. Upon termination, your access to AION ceases immediately. Provisions that by nature survive termination - including ownership, disclaimers, indemnification, and limitation of liability - will continue to apply.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which AION is incorporated. We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration or in the courts of competent jurisdiction in our home jurisdiction.

13. Meta Platform Compliance

AION is built on Meta's official APIs and complies with Meta's Platform Terms and Developer Policies. AION does not use Instagram data for advertising or tracking. AION does not share Instagram user data with third parties except as described in our Privacy Policy. AION requests only the Meta permissions necessary to provide the service. Users can revoke AION's Meta permissions at any time.

14. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of AION after that date constitutes acceptance of the updated Terms.
